Genesis Capital, LLC (“Genesis” or “we,” “us,” or “our”) may obtain certain confidential or nonpublic information about you in the course of our business. We endeavor to maintain the highest standards of confidentiality and to respect the privacy of our clients and associated persons, and other individuals whose personal information we collect and process. Our commitment to privacy includes being transparent about the nature and extent of that processing.

The Personal Information we collect comes from loan applications or other materials submitted to or obtained by Genesis during the course of our relationship with you. You are not required to supply any of the Personal Information that we may request. However, failure to do so may result in our being unable to provide services to you.

Sharing of Personal Information

We do not sell any of your Personal Information, including your name, mailing address or email address, to any companies.

Genesis also does not disclose your Personal Information to third parties, except as described in this policy. Third party disclosures may include sharing such information with non-affiliated companies that perform support services for your account or facilitate your transactions with Genesis, including those that provide professional, legal or accounting advice to Genesis. Non-affiliated companies that assist Genesis in providing services to you are required to maintain the confidentiality of such information to the extent they receive it and to use your Personal Information only in the course of providing such services and only for the purposes that we dictate.

We may also disclose your Personal Information to fulfill your instructions, to protect or exercise our rights and interests and those of our business partners, or as part of a corporate transaction with a successor or affiliate or in connection with any acquisition, merger, or sale of equity or assets, or pursuant to your express consent. Under limited circumstances, your Personal Information may be disclosed to third parties as permitted by, or to comply with, applicable laws and regulations or as required by law enforcement officials; for instance, when responding to a subpoena, court order or similar legal process, to protect against fraud and unauthorized transactions, and to otherwise cooperate with law enforcement or regulatory authorities.

Residents of California

If you are a resident of California, you have certain rights in relation to your personal information pursuant to the California Consumer Privacy Act (“CCPA”). These include your right to:

  • Request information about the personal information that we collect about you and the manner in which we process and disclose that information
  • Obtain the specific pieces of personal information that we have collected about you in the 12 months preceding your request
  • Request deletion of certain personal information that we have collected about you
  • Opt-out of disclosures of your personal information to third parties under certain circumstances
  • Not be discriminated against as a result of exercising any of the aforementioned rights

California residents should be aware that this section does not apply to information subject to a CCPA exception. Genesis will review any request for access to or deletion of your Personal Information, and/or to correct or amend any of the Personal Information you have provided to us, but Genesis reserves the right to deny such requests as allowed by law.  You can make a request by calling 800-663-2195 or emailing us at privacy@genesiscapital.com. Please include your name, address, and/or email address when you contact us. California law requires us to verify the requests we receive from you when you exercise certain of the rights listed above. To verify your request, we will check the information you provide us in your request (which may include your name, phone number, email address, address, and date of birth) against third party identity verification tools or verified information you have previously provided to us. As part of this process, we may contact you after you submit your request to verify information. You may also designate an authorized agent to exercise certain of the rights listed above on your behalf by providing the authorized agent with power of attorney pursuant to the California Probate Code or by executing other documentation we may require. The authorized agent may make the request on your behalf by following the instructions above. If an authorized agent submits a request on your behalf, we will contact you to verify that they represent you. California law requires that we describe certain disclosures of personal information where we receive valuable consideration. California law treats such disclosures as “sales” even if no money is exchanged. We do not sell information to third parties as defined under California law. We will not treat you any differently should you request access to or deletion of your personal information.

We will let you know if your request is denied. Access can be denied when, for example: giving one person access would compromise another’s privacy rights; disclosure is likely to interfere with the safeguarding of national security, defense, or public security; or disclosure could interfere with law enforcement or legal actions. These are only examples, and access may be denied in other situations in compliance with applicable laws.

Retention of Data

We will keep your Personal Information for as long as reasonably necessary to fulfill the purposes for which Personal Information is collected as stated herein; for as long as is necessary to comply with our contractual obligations; and to comply with legal and statutory obligations, such as in tax, trade and corporate laws.

Security of Data

Genesis will take reasonable steps to protect your Personal Information in our possession from loss, misuse, unauthorized access, disclosure, alteration, and destruction. For example, we use security measures including safeguarding and monitoring our network and controlling access to our files, equipment, and buildings.  We also engage in efforts to train our personnel on data security issues.

Changes to this Policy

We may update this policy to reflect changes to our information practices or legal requirements. If we make material changes to this policy, we will let you know by appropriate means, such as posting the revised policy on this page with a new effective date. The revised policy will become effective immediately upon posting to our website. Your use of the website following these changes means that you accept the revised policy. This version of the policy is effective as of December 20, 2021.
